These Terms & Conditions govern the design services provided by our company. By placing an order, making a payment, or proceeding with a design project, the client acknowledges that they have read, understood and agreed to the terms mentioned below.
- Order Confirmation & Project Scope
Every design project is created according to the requirements discussed and confirmed with the client at the time of placing the order.
The following details are generally confirmed through chat or other written communication before the order is processed:
- Type of design required
- Number of design options/concepts
- Project deliverables
- Expected delivery timeline
- Required file formats
- Other specific requirements related to the order
The scope of the project will be considered final as per the requirements and commitments communicated at the time of order confirmation.
Any requirement added after the order has been confirmed may be treated as additional work and may be chargeable.
- Project Delivery Timeline
The delivery timeline for each project is communicated to the client at the time of placing the order.
The applicable timeline will be the timeframe communicated and agreed upon in the project/order chat.
Delivery timelines may vary depending on:
- The complexity of the design
- Number of options included
- Client feedback and response time
- Additional requirements
- Delays in receiving necessary information or content from the client
Any timeline communicated by the company applies to the scope of work agreed upon at the time of order placement.
- Number of Design Options
The number of design options or concepts included in an order is communicated and confirmed with the client at the time of placing the order.
The client will receive the number of options agreed upon for that particular order.
Requests for additional concepts or options beyond the agreed quantity may be considered additional work and may involve additional charges.
The number of options provided will not be determined after the project has started and will remain based on the original order confirmation.
- Design Approval Process
Designs are prepared according to the client’s requirements and are shared with the client for final approval.
The client is expected to carefully review the design before providing approval, including:
- Design elements
- Text and spelling
- Colours
- Dimensions
- Layout
- Contact information
- Other relevant details
The design will proceed to final rendering/export only after the client provides approval.
- Client Approval & Finalization
Once the client approves a design, that approval will be treated as confirmation that the client has reviewed and accepted the design.
After approval, the approved design may be:
- Rendered/exported into the required format; or
- Prepared and delivered to the client.
The client is therefore responsible for checking the design carefully before giving final approval.
- Changes After Final Approval
Once a design has been approved by the client and the final files have been rendered, exported or delivered, any subsequent correction, modification or change requested in the original/source design will be treated as additional work.
This includes, but is not limited to:
- Text corrections
- Spelling corrections
- Colour changes
- Layout changes
- Size or dimension changes
- Changes to design elements
- Addition or removal of elements
- Any other modification to the approved design
Such changes will be chargeable.
The applicable charges will be communicated by the company based on the nature and time required for the requested changes, and the charges will be payable by the client before the requested changes are carried out.
- Responsibility After File Delivery
Once the final files have been rendered/exported and delivered to the client, the client is responsible for reviewing and verifying the delivered files.
The company will not be responsible for corrections or modifications requested after final approval and delivery, where the delivered files correspond to the design approved by the client.
Any further designing or modification required after delivery will be treated as a new/chargeable requirement.
- Design Information & Source Files
The relevant design specifications and information are retained within the applicable source/design files wherever technically applicable.
For logo and branding projects, this may include information such as:
- Colour codes
- Design dimensions
- Design proportions
- Typography/font information, where applicable
- Design elements
- Other relevant specifications associated with the artwork
The source file is therefore an important part of the final design deliverables.
- Logo & Design File Deliverables
For applicable logo design orders, the standard final deliverables may include:
- JPG
- PNG
- One source/editable file
The source file may be provided in a suitable format such as:
- CDR
- AI
- PSD
- Or another applicable editable design format
The exact deliverables may vary depending on the package/order and will be confirmed at the time of order placement.
- Trademark-Specific Requirements
If the client intends to use the design or logo for trademark registration, the client must inform the company about this requirement before the design work begins or at the time of placing the order.
Any specific requirements communicated after the design has been finalized or delivered may require additional work and may be chargeable.
The client is responsible for independently verifying whether the final design meets the requirements of the relevant trademark authority.
Unless specifically agreed otherwise, the company does not guarantee trademark registration or approval of any design.
- Client-Provided Information
The client is responsible for providing accurate information, text, names, spellings, colours, dimensions and other required details before final approval.
The company will use the information provided by the client while preparing the design.
If an error exists in the information provided by the client and the client approves the design containing that information, any subsequent correction requested after approval may be treated as chargeable work.
- Additional Requirements
Any requirement that was not part of the original order or was not communicated and agreed upon at the time of order placement may be considered an additional requirement.
Additional requirements may include:
- Extra design concepts
- Additional options
- New design variations
- Major design changes
- Additional file formats
- Changes to an already approved design
- Reworking a finalized design
Charges, if applicable, will be communicated before the additional work is undertaken.
- Final Approval
The client’s final approval is an important part of the design process.
By approving a design, the client confirms that:
- The design has been reviewed;
- The requested changes, if any, have been completed;
- The content and information have been checked;
- The client is satisfied with the approved version; and
- The design may proceed for final rendering/export and delivery.
Once approval has been provided, subsequent modifications will be treated according to the post-approval terms mentioned above.
- Payment for Additional Work
Where any correction, modification or additional requirement is chargeable, the client will be informed of the applicable charges.
The additional amount will be payable by the client before the additional work is undertaken.
The applicable charge may depend on the complexity of the requested change and the time required to complete it.
- Ownership & Use of Final Designs
The client may use the final approved design for their intended business and promotional purposes after completion of the order and settlement of all applicable payments.
Third-party elements, fonts, stock assets or other licensed materials, where used, remain subject to their respective licensing terms.
The company retains the right to showcase completed design work in its portfolio, website, social media or promotional material unless confidentiality has been specifically agreed upon with the client.
- Limitation of Liability
The company will make reasonable efforts to deliver designs according to the requirements confirmed at the time of order placement.
However, once the client has approved the final design and the approved files have been rendered/exported or delivered, the company shall not be responsible for changes, corrections or modifications subsequently requested by the client.
Any such requirement will be treated as additional chargeable work.
- Acceptance of Terms
By placing an order, making a payment, or proceeding with the design project after receiving the applicable project details, the client confirms that they have read, understood and accepted these Terms & Conditions.
The order-specific terms communicated through written communication, including chat, regarding scope, number of options, deliverables and timeline will form part of the applicable project agreement.
